1. ANIMAL IDENTIFICATION: The animal described
herein shall arrive at White Oak Ranch properly identified along with any information that
may be pertinent or helpful in the handling of the animal, with special emphasis on any
peculiarities or traits of the animal. Mare's Name

2. BOARD, FEED AND GENERAL CARE: White Oak Ranch agrees to
provide board, feed and general care for the animal covered in this agreement. The
mare owner is to pay $______________ per day for the said animal, The mare owner
further agrees that they have made themselves aware of the facilities, feeding program and
general care given by White Oak Ranch and they approve of the same.
3. The stud fee shall be $____________ . This fee
includes a $___________ non-refundable booking fee which is due upon the signed return of
this contract to Gayle Atkins. The balance of the stud fee, $____________ , is due
prior to the first cover of the mare.
4. We will breed the mare during the current breeding season
until she is in foal. The breeding season is March 15 - August 1.
5. If the mare does not produce a live foal, one that stands
and nurses on its own, then the mare owner's veterinarian must prepare a death certificate
and it must be sent to Gayle Atkins within five days of the death or Gayle Atkins is
released from the obligation to rebreed. If a live foal is not produced and the mare
owner has complied with all the conditions herein described, the mare will be rebooked and
rebred when specified by Gayle Atkins during current and/or consecutive breeding seasons
until she produces a live foal. If Gayle Atkins and/or her veterinarian deems that
the mare is unbreedable, an approved substitute mare may be allowed by Gayle Atkins at her
option. A rebooking fee of $250.00 will be charged for each season the mare or
substitute mare is bred.
6. The mare owner will provide a veterinary certificate prior
to breeding, certifying condition of general health, rectal and vaginal examination, and
cultured if needed. Gayle Atkins reserves the right to approve the mare prior to
breeding.
7. I, the mare owner, give authority to Gayle Atkins, White
Oak Ranch and/or a qualified veterinarian to reexamine the mare and administer medical or
other care if deemed necessary, including deworming, ovarian and/or pregnancy checks,
culturing and treatment of any disease, all at my expense.
8. Gayle Atkins and White Oak Ranch shall not be liable for
failure of the mare to be bred and produce a live foal for any reason whatsoever.
9. White Oak Ranch and Gayle Atkins release the mare owner
from any liability for sickness, disease, accident or injury, or loss of stallion arising
out of the condition or acts of the mare, and the mare owner releases White Oak Ranch and
Gayle Atkins and their employees from any liability for sickness, disease, accident or
injury, or loss of the mare or any foal.
10. Should the stallion die, be sold, or become unfit for
services, this contract is and shall become null and void. The determination as to
the stallion's fitness shall be made by the veterinarian regularly in attendance for Gayle
Atkins.
11. Board, feed, general care, foaling services and trim
services provided by White Oak Ranch shall be charged at the current rates and are not
included in the stud fee, nor are veterinary services. These charges shall be due as
billed monthly, and the undersigned mare owner shall pay all outstanding charges prior to
the time of the mare's departure from White Oak Ranch.
12. The mare owner agrees to keep the mare in good physical
condition throughout the pregnancy, vaccinate for rhinopneumonitis at five, seven, and
nine months of pregnancy, and deworm regularly with an FDA approved agent for pregnant
mares or all return privileges and stud fees are forfeited. |
